Topics of International Family Law<\/h2>\n\n\n\n<p>In international family law, two questions always need to be clarified:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Firstly, which country's court has jurisdiction, and<\/li>\n\n\n\n<li>secondly, which national law it must apply.<\/li>\n<\/ul>\n\n\n\n<p>Depending on the family law matter in question, different regulations must be consulted. Often only lawyers specialized in international family law can keep track of the many different laws.<\/p>\n\n\n\n<p>Some examples of frequent disputes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For those entitled to maintenance, it is often difficult to enforce their&nbsp;<a href=\"https:\/\/kanzlei-drschmidt.de\/en\/familienrecht\/unterhalt\/\"><strong>claim to maintenance<\/strong><\/a>&nbsp;against someone who is residing in another state. The competent authority and contact point in Germany is the Federal Office of Justice. Specifically for EU countries, the EU Maintenance Regulation applies, which facilitates the Europe-wide enforcement of maintenance claims.<\/li>\n\n\n\n<li>Also for cross-border questions regarding&nbsp;<a href=\"https:\/\/kanzlei-drschmidt.de\/en\/familienrecht\/sorge-umgangsrecht\/\"><strong>custody<\/strong><\/a>&nbsp;the Federal Office of Justice is responsible. Germany is a contracting party to several international agreements that provide regulations for cross-border custody and access rights issues. In practice, international child abduction (especially from Germany abroad) in violation of custody rights is of great importance. However, it is also frequently about the recognition and enforcement of foreign custody or access rights decisions for a child living in Germany.<\/li>\n\n\n\n<li><strong>Paternity Questions<\/strong>&nbsp;also often arise cross-border, such as the recognition or establishment of paternity. They are decided primarily according to the law of the state in which the child habitually resides.<\/li>\n\n\n\n<li>There are new developments in international&nbsp;<strong>marital property law<\/strong>For marriages concluded on or after January 29, 2019, the law of the state where the spouses had their first common habitual residence after the marriage primarily applies. The new&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/?uri=uriserv:OJ.L_.2016.183.01.0001.01.DEU&amp;toc=OJ:L:2016:183:TOC\" target=\"_blank\" rel=\"noreferrer noopener\">europ\u00e4ischen G\u00fcterrechtsverordnungen<\/a>&nbsp;apply in all EU countries except the UK, Ireland, Denmark, Estonia, Latvia, Lithuania, Poland, Romania, Slovakia, and Hungary.<\/li>\n<\/ul>\n\n\n\n<p>In these and other difficult questions of international family law, attorney Dr. Christina Schmidt knows what to do and helps you with the cross-border enforcement of your rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a><\/a>2. International Divorces<\/h2>\n\n\n\n<p>International family law very often deals with divorces with an international connection. These are those in which either at least one spouse is a foreigner or lives abroad. Even for couples with German citizenship living abroad, the special features that apply to international divorces must therefore be observed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.1. Das zust\u00e4ndige Gericht<\/h3>\n\n\n\n<p>Which court is responsible for the divorce is determined in the EU according to the&nbsp;<a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2003:338:0001:0029:DE:PDF\" target=\"_blank\" rel=\"noreferrer noopener\">Brussels II a Regulation<\/a>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Accordingly, a German court is, for example, competent if both spouses are German, even if they live abroad, or if both have their habitual residence in Germany, regardless of whether they are foreigners.<\/li>\n\n\n\n<li>The court of the country in which the couple last lived may also have jurisdiction, if one partner still lives there currently.<\/li>\n\n\n\n<li>Likewise, the court of the country in which one of the partners lives, if both jointly file the divorce application, or<\/li>\n\n\n\n<li>the country in which the partner lives against whom the other files the divorce application.<\/li>\n\n\n\n<li>The court of the country in which the applicant lives who files for divorce may also have jurisdiction. However, he must have already lived there for a minimum period of time.<\/li>\n<\/ul>\n\n\n\n<p>Outside the EU, the regulation is not applicable. In Germany, the Act on Proceedings in Family Matters (FamFG) must then be consulted. It names further cases in which German courts have jurisdiction for international divorces.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.2. Das anzuwendende Recht<\/h3>\n\n\n\n<p>Even if a German&nbsp;<a href=\"https:\/\/www.justiz.bayern.de\/gerichte-und-behoerden\/amtsgerichte\/muenchen\/verfahren_06.php\" target=\"_blank\" rel=\"noreferrer noopener\">Family Court<\/a>&nbsp;has jurisdiction does not yet mean that the divorce automatically also follows German law. Rather, the applicable law is derived from the&nbsp;<a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2010:343:0010:0016:DE:PDF\" target=\"_blank\" rel=\"noreferrer noopener\">Rome III Regulation<\/a>. This applies in Belgium, Bulgaria, Germany, France, Italy, Latvia, Lithuania, Luxembourg, Malta, Austria, Portugal, Romania, Slovenia, Spain and Hungary.<\/p>\n\n\n\n<p>The married couple can choose according to which law they want to be divorced. They can decide on the country in which they live, last lived together (provided one of them still does so at the present time), of which nationality one of the partners has, or in which the divorce is filed.<\/p>\n\n\n\n<p>If the spouses do not make use of their right to choose, the following order applies: First, the law of the country in which the couple has its habitual residence applies, then that of the country in which they last had it, subordinately that of which the spouses have common nationality, and finally the law of the country in which the couple files for divorce.<\/p>\n\n\n\n<p>Outside the scope of Rome III, the jurisdiction of a German court is determined according to German private international law (EGBGB). Here too, there are certain choices, albeit within narrower limits. No choice of law is possible under the EGBGB if the spouses have\/had the same nationality and one still possesses it. In this case, the law of that state applies mandatorily.<\/p>\n\n\n\n<p>Before which court or according to the law of which country a divorce is carried out is quite important for couples who want to separate. In some countries there are regulations that differ greatly from German law and can have both more favorable and less favorable effects. Dr. Christina Schmidt informs you about the advantages and disadvantages of the respective countries and advises you on the choice of law.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In certain countries, a divorce can be more cost-effective, for example. In Russia, for instance, one also knows a divorce before the registry office.<\/li>\n\n\n\n<li>Separation periods can be shorter or eliminated entirely (example: Netherlands).<\/li>\n\n\n\n<li>In part, maintenance claims are significantly higher (example: England) or lower: Anyone who, for example, is assigned blame in a contentious divorce in Austria or Portugal has lower or no maintenance claims at all! Both countries, unlike Germany, still recognize the so-called fault principle in divorces.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2.3. Internationale Anerkennung von Scheidungen<\/h3>\n\n\n\n<p>With divorces with an international connection, an additional problem arises: They are not automatically recognized cross-border. However, recognition is extremely important, as otherwise the ex-partners usually cannot enter into a new marriage, for example. The lack of recognition also has other far-reaching consequences. If the couple continues to be considered married in one country, the previous spouse remains, for example, the legal heir of the ex-partner. Tax and immigration law consequences must also be considered. For problems with divorce recognition, the advice of an experienced lawyer is therefore essential for these reasons.<\/p>\n\n\n\n<p>In Germany, foreign divorces must be recognized in an official procedure in order to also be legally valid in this country. The same applies conversely for German divorces that are to be valid abroad. The procedure is simplified for states that are party to the Hague Agreement. These include, for example, the USA, Thailand and Turkey. A list of all signatory states can be found on the&nbsp;<a href=\"https:\/\/www.bundesjustizamt.de\/DE\/Themen\/Buergerdienste\/BZAA\/Vertragsstaaten\/Vertragsstaaten_node.html\" target=\"_blank\" rel=\"noreferrer noopener\">website of the Federal Office of Justice<\/a>.<\/p>\n\n\n\n<p>An exception is made within the EU. Here, no special recognition procedure is necessary anymore. Divorces from other EU states are recognized in every member country if the divorce judgment and a certificate issued by the competent authority of the respective member state are presented. Denmark is an exception.<\/p>\n\n\n\n<p>Even in the case of so-called \"home state decisions,\" no recognition is necessary. This is the term used when the marriage was divorced by a court of the state whose sole nationality both spouses had at the time of the divorce.
